2.    PUBLIC COMMUNICATIONS: This is the public’s opportunity to speak on any topic not listed on this agenda. Comments shall be limited to three (3) minutes (or less). Please note, however, in accordance with the Brown Act, the Planning Commission cannot deliberate or vote on any matter raised under public communications, but may briefly respond to statements made or questions posed (Government Code Sections 54954.2)

a. Consideration of an Appeal of VHR Permit #102361 Expiration, 1010 Tahoe Island Drive, South Lake Tahoe, California (pg. 04)

Recommendation: Hear staff report; open public hearing; receive public input; receive commissioner comments; and take one of the following actions:

1. The Planning Commission could deny the appeal pursuant to South Lake Tahoe City Code §3.50.400 (B) & (C) finding that the VHR Permit #102361 was not renewed in a timely manner and has expired, and adopt Planning Commission Resolution 2019-05; or

2. The Planning Commission could make the necessary findings; grant the appeal and direct staff to immediately process the renewal of VHR Permit #102361, and adopt Planning Commission Resolution 2019-05; or

3. The Planning Commission could take no action and refer the matter to the City Council.

b. Consideration of an Appeal of VHR Permit #005259 Expiration, 1139 Fairway Avenue, South Lake Tahoe, California (pg. 26)

Recommendation: Hear staff report; open public hearing; receive public input; receive commissioner comments; and take one of the following actions:

1. The Planning Commission could deny the appeal pursuant to City Code §3.50.400 (B) & (C) finding that the VHR Permit #005259 was not renewed in a timely manner and has expired, and adopt Planning Commission Resolution 2019-04; or

2. The Planning Commission could make the necessary findings; grant the appeal and direct staff to immediately process the renewal of VHR Permit 005259, and adopt Planning Commission Resolution 2019-04; or

3. The Planning Commission could take no action and refer the matter to the City Council.

c. Consideration of a Sign Application to Grant Locally Unique Sign Designation for Two Off-Premise Directional Freestanding Signs located at the corner of Third Street and Lake Tahoe Boulevard and B Street and Emerald Bay Road, Barton Health, 2170 South Avenue, South Lake Tahoe, California(pg.41)

Recommendation: Hear staff report; open public hearing; receive public input; receive commissioner comments; and take one of the following actions:

1. Find that the project is categorically exempt from CEQA under Section 15301, Class 1 (existing facilities); and

2. Adopt Resolution 2019-06 designating the Barton Health off-premise directional freestanding signs as locally unique.
